New Build or Resale in Calgary? Show Homes, the Alberta New Home Warranty, GST Rebates and Builder Checks (2026)

by Ben Sweet

TL;DR

  • The builder's sales rep works for the builder; bring your own agent from the first visit.
  • Alberta's new home warranty covers at least 1 year (materials), 2 years (systems), 5 years (envelope) and 10 years (structure).
  • Check any builder for free on Alberta's Builder Registry.
  • Pre-construction condo buyers can cancel within 10 days, and deposits must be held in trust.
  • First-time buyers can get back up to $50,000 of GST on a new home up to $1 million.

New construction in Calgary's newer communities like Mahogany, Seton and Belmont competes with resale homes only a few years old. The questions buyers bring us are about who's on their side in the show home, what the warranty really covers and how to check a builder. Here are straight answers, with the provincial rules behind them.

How does a new build compare with a 5-year-old resale?

A new build comes with the full 1, 2, 5 and 10-year warranty but carries GST and often a wait; a 5-year-old resale has about five years of structural warranty left, no GST, and a move-in date you choose.

New build

  • Full warranty: 1, 2, 5 and 10 years
  • GST payable (rebates may apply)
  • Possibly a wait for construction
  • Landscaping, blinds and fencing may be extra

5-year-old resale

  • About 5 years of structural warranty left
  • No GST on a resale home
  • Move in on your chosen date
  • Usually already finished outside

Real situations: what are Calgary new-build buyers really asking us?

New build in Mahogany or a 5-year-old resale in Auburn Bay: bring my own realtor? What does the warranty cover?

Bring your own agent from your first show-home visit, because the person in the show home works for the builder. A builder's own employee selling the builder's homes is outside Alberta's Real Estate Act, so that rep may not hold a real estate licence at all (Real Estate Act, s. 2(1)(c), consolidated September 1, 2026). Ask when your agent must be introduced before you fill in a guest card.

Price hardly separates them: from January to October 2026 the median detached sale was $760,000 in Mahogany and $739,900 in Auburn Bay (CREB Housing Data Map, read November 1, 2026; more areas in our Calgary home prices by community). The warranty does. Every new Alberta home carries at least 1 year on labour and materials, 2 years on electrical, plumbing and HVAC delivery systems, 5 years on the building envelope and 10 years on major structure (alberta.ca). Coverage follows the house, so a five-year-old Auburn Bay home usually has only its structural years left.

  1. Look up the resale's address in the free Property Registry for its warranty start date.
  2. Compare the new build's price after GST and extras (landscaping, blinds, fencing) with the resale's.

An Airdrie builder's rep says we'll get a better deal without our own realtor. True? Who pays the realtor on new construction?

No Alberta rule lowers your price for coming alone, and the person telling you so is paid by the builder. Whether the builder pays a buyer's agent, and how much, is the builder's own policy rather than anything set by law, so get its answer in writing before your first visit.

Whoever pays, Alberta requires your agent to sign a written service agreement with you that states the amount or method of calculating their pay and when it becomes payable (Real Estate Act Rules, s. 43). Read that clause for what happens if the builder pays less than the agreement says.

Airdrie buyers have some room: the town's benchmark price was $505,800 in September 2026, nearly 4% lower than a year earlier, with about four months of supply (CREB, October 1, 2026 release).

  1. Ask the rep by email: do you pay a buyer's agent, and must I register them on my first visit?
  2. Compare the price with recent Airdrie resales.
  3. Negotiate beyond price: upgrades, appliances, landscaping, closing-cost credits or the possession date, especially on finished spec homes.
  4. First-time buyer? Ask whether the price assumes the builder claims your GST rebate.

Pre-construction Mahogany townhouse, finished in 2028, 15% down in deposits: is that protected if the builder goes under?

That depends on how the townhouse will be titled, so confirm it before you pay anything. If it's a condominium unit, the Condominium Property Act requires the developer to place your deposit in a trust account at an Alberta financial institution, kept by a prescribed trustee, within 3 days, unless a Minister-approved protection plan covers it; any amount above that plan's limit must still go into trust (s. 14, consolidated May 14, 2026). You can also cancel within 10 days of the later of signing or receiving the full disclosure package.

If it's freehold, that Act doesn't apply, and the province's minimum warranty doesn't list deposit protection. Some warranty providers sell optional deposit insurance; one lists caps of $50,000 for multi-family homes and $100,000 for single-family homes before construction starts (provider page dated May 23, 2025). For scale, 15% of Calgary's September 2026 row-house benchmark of $412,400 (CREB) is about $61,900.

  1. Ask the builder in writing: condo or freehold, trust or insurance, with whom, and to what limit?
  2. Have your real estate lawyer confirm it before each deposit.

Our south Calgary new build is delayed six months and our lease is ending. What are our rights, and who helps?

For a house, your rights come mainly from your purchase agreement; for a condo unit, Alberta law adds firm ones. Under the Condominium Property Regulation, if the unit isn't ready within 30 days after the final occupancy date in the statement you initialled, you can cancel in writing and be refunded in full within 15 days. A revised date binds you only if you accept it in writing or don't cancel within 10 days of the notice. Delays from listed causes such as fire, flood or a late development permit are excused, and you keep the right to claim damages (ss. 20.07–20.11, consolidated February 15, 2026).

For a house, check the estimated possession date, any extension clause, the notice the builder owes you and the deposit terms. The provincial warranty covers defects, not delays or extra rent.

On housing: a fixed-term lease ends on its date, so ask your landlord now about going month to month; as a monthly tenant you'd owe one full tenancy month's notice (alberta.ca).

  1. Get the delay and new date in writing.
  2. Have a lawyer review the contract.
  3. We can read the agreement with you and negotiate with the builder.

Our 14-month-old Okotoks home has basement slab cracks and doors that won't close, and the builder isn't responding. What now?

Past year one you're still covered for delivery systems to year 2, the building envelope to year 5 (7 if your builder bought the extension) and major structure to year 10, counted from the earliest of occupancy, permission to occupy or title transfer (alberta.ca). The province's Construction Performance Guide puts slab cracks over 3 mm (width or displacement) and rubbing or binding interior doors under the 1-year coverage. They remain claimable if water comes through the slab (5-year envelope) or if the movement points to a structural defect, meaning failure of a load-bearing part (10 years). Cracks plus doors that suddenly stop closing are worth having assessed for exactly that.

You don't need the builder's reply to start: claims go to your warranty provider (alberta.ca).

  1. Find your provider and start date in the free Property Registry.
  2. Measure and photograph each crack and door, with dates; keep any year-one emails.
  3. Send written notice to the provider and the builder. The guide warns that late notice can affect a claim.
  4. If refused, ask for written reasons, then call the Residential Protection Program (1-866-421-6929) about dispute options.

How do I check a builder before signing?

Search the builder in Alberta's free Builder Registry. It shows licence status and class, the people in control, related companies, enforcement actions and how many homes they've built in Alberta since February 1, 2014. Every residential builder needs a provincial licence renewed yearly, and from January 1, 2027 builders applying or renewing must meet new competency requirements (alberta.ca). Then walk their finished streets and ask owners how warranty service went.

How much GST do we get back on a new home?

It depends on the price and whether you're a first-time buyer. First-time buyers can recover up to 100% of the GST, to a maximum of $50,000, on a new home up to $1 million (reduced up to $1.5 million) if the agreement was signed on or after March 20, 2025 (CRA). Other buyers using it as their main home may get the regular rebate: 36% of the GST up to $6,300, in full at $350,000 or less and phased out by $450,000 (CRA). Ask whether the builder's price assumes they'll claim it for you, and see our first-time buyer guide.

Do I need a realtor for a new build in Calgary?

You don't need one, but it's worth having someone who works only for you, because the builder's sales staff work for the builder. Ben Sweet & Associates (Real Broker) has sold over 2,000 homes since 2002, including new builds, and has 714 verified RankMyAgent reviews at 4.99/5 (November 1, 2026). Confirm in writing who pays your agent before you sign anything with a builder.
